Uttam Khao, Cashback Pao! Festive Offer 2025 – Terms & Conditions
1. SCOPE OF THE CONSUMER OFFER:
a. “Uttam Khao Cashback Pao!” is a consumer offer launched, executed and sponsored by Sethia Foods.
b. This consumer offer is applicable to a select range of products wherein to participate in this Consumer Offer, the consumer must purchase any promotional pack as defined hereinunder.
c. These terms and conditions govern this Consumer Offer and all aspects thereof. By availing the Consumer Offer and participating in the “Scan the barcode” activity, the participants fully and unconditionally acknowledge and accept these terms and conditions in their entirety, which are readily available for review at https://madeinbikaner.com and campaign URL.
d. This Consumer Offer and participation are subject to Company’s Privacy Policy, which can be accessed at the campaign URL & website (https://madeinbikaner.com)

2. DEFINATIONS
1. Consumer offer shall mean this Consumer Offer (i.e., Uttam Khao, Cashback Pao!) launched by Sethia Foods.
2. Consumer Offer Period shall mean the period of this Consumer Offer, as defined hereinunder.
3. Terms & Conditions shall mean these Terms and Conditions governing this Consumer Offer.
4. Customer(s) shall mean any person, who purchases any pack(s) of Uttam’s brand of products, featuring the Uttam Khao, Cashback Pao! Promotion on the packaging, on the following products:
i. Uttam Classic Indian Sweets 1.25 kg: Rasgulla, Rajbhog, Gulab Jamun, Kesar Bati, Cham Cham, Angoori Petha, Rasbhari, Pantua Gulab Jamun, Mini Gulab Jamun.
ii. Uttam ATM 1 kg: Rasgulla, Gulab Jamun, Bati, Cham Cham, Rasbhari, Rajbhog.
iii. Uttam Soan Papdi 400 g: Elaichi, Desi, Coconut, Orange, Chocolate, Pineapple.
iv. Uttam Soan Papdi 900 g: Desi and Elaichi.
5. A cashback offer means receiving a portion of the money you spend back as a reward, essentially getting a discount on your purchases.

3. CONSUMER OFFER PERIOD:
1. The Consumer Offer will commence at 10:00:00 AM Indian Standard Time (“IST”) on Monday 21st July,2025(“Start Date”) and will continue until Stock last (“Consumer Offer Period”). Sethia Foods reserves the right to cancel/ modify/ extend the Consumer Offer Period, at its sole discretion, without giving any prior notice or intimation.
2. Non-promo packs will also be available in the market during the promotional period.
3. Further, certain stock of Sethia Foods Products featuring the Consumer Offer may be available before the Consumer Offer Period or may continue to be available even after the Consumer Offer Period. However, prospective Participants acknowledge and agree that participation in the Consumer Offer is only permitted within the specified Consumer Offer Period and further, agree not to raise any claim or complaint against the Sethia Foods, its affiliates or its agents regarding this matter. However, Sethia Foods/ Agency(s) reserves the exclusive right to accept or reject requests received during the Consumer Offer Period, if
any.

4. TERRITORY AND APPLICABLE LAWS:
1. Subject to the other criteria and conditions stated in the terms of the Consumer Offer, the offer will be open to all the residents of India and within India, except the state of Andaman & Nicobar Islands.
2. The Consumer Offer is subject to all the applicable central, state and local laws and regulations of India.

5. ELIGIBILITY TO PARTICIPATE:
1. This Consumer Offer is available to every individual, who is 18 years of age or above and residing in India.
2. Participants should not be facing or involved in any criminal, civil or other legal proceedings, which could adversely affect their participation in the Consumer Offer in any way.
3. By participating in this Consumer Offer, each Participant agrees and consents to provide their Name, Mobile number, Pin code and UPI id to Sethia Foods/Agency(s), as applicable (if it has not been previously provided) for the purpose of written/ verbal communications by Sethia Foods/Agency(s), as applicable, with regard to the Consumer Offer. Participants, who don’t possess valid information will be ineligible to participate in the Consumer Offer.
4. Participants, upon request by Sethia Foods/ Agency(s), must provide their PAN Card and Aadhar Card (collectively referred to as the “ID Proof”) for the purpose of verification.
5. In the event wherein any of the required information is unavailable for any reason, Sethia Foods/ Agency(s) reserves the right to withdraw the reward and such decision shall be final and binding.
6. Sethia Foods/ Agency(s) reserves the right to exclude any individual from participating in the Consumer Offer on grounds, including but not limited to misconduct, misrepresentation, coercion, fraud, deceit or for any other reasons, deemed appropriate. No correspondence or appeals regarding such exclusion from the Participant or his representatives shall be entertained by Sethia Foods/ Agency(s).

6. HOW TO PARTICIPATE/ AVAIL THE OFFER:
In order to avail this Consumer Offer, Participants have to follow these steps:
1. Buy a Uttam product featuring the consumer offer on it.
2. Scan the QR code on the pack, which will take you to a landing page of Consumer Offer (such scan shall be done through a smart phone only, no other means will be permitted under this consumer offer).
3. On the landing page, enter your details, as requested and click on the submit button.
4. Enter the verification code received on the mobile number provided by the  Participant in the step 3 above.
5. Open the pack, find the unique code printed inside the featured pack.
6. Enter the unique code, as requested.
7. Click on the option to ‘Claim Your Reward’.

7. CASHBACK AND ELIGIBILITY:
1. The Sethia Foods/ Agency(s), their associates, directors, officers, agents and representatives shall have no liability for any deficiency or dispute arising in relation to and/ or concerning the offer. Sethia Foods/ Agency(s) will not entertain any claims or complaints, whatsoever, regarding the consumer offer.
2. The representations of the cashback in the advertisements, posters, pack shots and other promotional materials are for illustrative purposes only and the actual offer may differ in appearance and specifications from those depicted.
3. The cashback awarded under this Consumer Offer is free of cost, subject to the conditions and consumers are not required to make any type of payment by any means to Sethia Foods/ Agency(s). Sethia Foods/ Agency(s) shall not be responsible for any loss or
damage incurred by the Participant, if any, wherein money is paid, transferred or bank or card related details are shared by the Participant.

8. RIGHT TO USE DATA COLLECTED AS PART OF THE CONSUMER OFFER:
1. By participating, each Participant expressly consents and hereby irrevocably and unconditionally permits Sethia Foods/ Agency(s) to cover and promote the Consumer Offer through various media channels, including newspapers, radio, television, news channels, internet, point of sale materials, digital media and all other modes and shall not raise any objection or make any protest or claims regarding such coverage or promotion.
2. Each Participant acknowledges and agrees that Sethia Foods/ Agency(s) may use their data, including their name, mobile number and other information, for Sethia Foods promotional and other reasonable purposes. All rights associated with the data, including but not limited to intellectual property rights, copyrights and all other allied, ancillary and subsidiary rights shall be the exclusive property of Sethia Foods/ Agency(s), in perpetuity and throughout the world.
3. Sethia Foods/ Agency(s) will collect personal information from Participants, including
their official name (any alias), Mobile Number and any other necessary details for administering and conducting the Consumer Offer. Participant understands that failure to provide the required information may result in Sethia Foods/ Agency(s) exercising its sole discretion regarding the Participant's eligibility and participation in the Consumer Offer.
4. By participating in the Consumer Offer, unless otherwise advised, each Participant grants Sethia Foods/ Agency(s) and its affiliates the right to use their personal information for future promotional, marketing and publicity purposes, this may include disclosing the information to third parties for such purposes. Participants understand that Sethia Foods/ Agency(s) is not liable or obligated to provide acknowledgement, give credits, further references, compensation or any other form of remuneration or recognition to the Participant. Additionally, participant’s personal information may be disclosed to statutory authorities, if required, as per applicable laws.

9. EXTENT OF LIABILITY/ OBLIGATION OF SETHIA FOODS AND AGENCY(S):
1. Sethia Foods/ Agency(s) shall not be held responsible, if Participants do not receive the cashback, on account of not meeting the Eligibility Criteria.
2. Sethia Foods/ Agency(s) shall not be responsible for, including but not limited to:
1. Any lost, late or misdirected data or mobile transmissions, network or electronic failures or any other issues preventing the receipt of data owing to transmission failures or due to any technical or any other reason;
2. Any other conditions beyond the control of Sethia Foods/ Agency(s), including not limited to Force Majeure.

10. INTELLECTUAL PROPERTY RIGHTS:
1. All rights, title and interest, including but not limited to Intellectual Property Rights, in the promotional material(s) and any or all responses received shall be the sole and exclusive property of the Sethia Foods. Sethia Foods or any other party authorized by Sethia Foods shall be entitled to use these responses or any other information connected with Participant’s data or information in any media for future promotional, marketing, publicity and any other purposes, without requiring any additional permission or providing
consideration to the Participant.

12. GENERAL TERMS AND CONDITION
1. By participating in this Consumer Offer, each Participant represents and warrants that such Participant is legally competent to enter into binding contracts and/ or agreements, in accordance with the applicable laws. Additionally, the Participant warrants that all the personal information provided by such Participant, including name, state, city, pin code, phone number, etc., is true, correct, accurate and complete in all terms.
2. Cashback will be selected based on the random selection.
3. No queries, claims, dispute, complaints or grievances shall be entertained by Sethia Foods/ Agency(s), if submitted after 2 days from the closure of the Consumer Offer Period.
4. Nothing contained in these terms and conditions shall be construed as a commitment or representation by Sethia Foods to conduct any further Consumer Offers, Promotions or Contests.
5. Sethia Foods or any of its respective officers, employees, directors and associates shall not be held responsible for any delays, losses, mutilations, corruptions, or illegibility of information or any other related issues.
6. These Terms shall be governed by and construed in accordance with the applicable laws of India. Any dispute, including those arising in connection with this Consumer Offer, shall be subject to the exclusive jurisdiction of the Courts in Bikaner, Rajasthan, India. Any and all disputes, complaints or queries, if any, shall be submitted within 2 days following the conclusion of the Consumer Offer Period.
7. The interpretation and implementation of the terms and conditions shall be at the sole discretion of the Sethia Foods/ Agency(s). The decisions made by Sethia Foods/ Agency(s) regarding any aspect of the Consumer Offer shall be final and binding and shall not be subject to challenge or appeal.
